It was the eighteenth Collegiate Court on Administrative Matters of the First Circuit that denied protection to Grupo Elektra.
The judges agreed with the SAT, recognizing that the company has the obligation to pay an Income Tax (ISR) debt corresponding to the 2008 financial year for an amount close to 2 thousand 11 million pesos updated today.
Let us remember that the tax collection and oversight body in our country determined that the company, owned by businessman Ricardo Salinas Pliego, had an ISR debt.
However, it did not pay said lien because it alleged alleged losses from having sold shares of other companies.
The company then challenged the tax authority’s decision by filing a lawsuit before the Federal Court of Administrative Justice.
But, the ruling in the first instance was favorable to the SAT, so the company objected in a second instance, which it lost again when the plaintiff’s arguments were rejected.
Although still, if it considers it, Elektra can challenge this resolution in a third instance before the Supreme Court of Justice of the Nation (SCJN).
